The judge in the case of a former Vandalia Correctional Center officer charged with official misconduct and bringing contraband into a penal institution has recused himself. Judge Marc Kelly was set to preside over Tuesday’s scheduled pre-trial in the case of 30-year old Cody J. Hawkins for the first time since taking over for the previous judge, but recused himself from the case. Judge Michael McHaney then presided over the matter on Tuesday in which the court approved for Hawkins’ bond conditions to be modified so that Hawkins may attend a medical appointment out of state. The pre-trial was then reset for January 30 at 1p.m. Hawkins is charged with one count of Bringing Contraband Into a Penal Institution, which is a Class 1 Felony and punishable by 4 to 15 years in prison. Hawkins is also charged with Official Misconduct, a Class 3 felony punishable by 2 to 5 years in prison and one count of Unlawful Possession with Intent to Deliver a Controlled Substance, also a Class 3 Felony punishable by 2 to 5 years in prison.
