Sentencing for a Vandalia woman who entered an open plea of guilty back in October for aggravated battery of her at the time 3 ½ month old son, has been continued until January. 24-year old Aubree Hammer was set to be sentenced in November in Fayette County Court, however, due to the length of the pre-sentence investigation report, that sentencing hearing date was abandoned by the state and defense due to the length of the pre-sentencing investigation report filed in November being well over 200 pages. The original sentencing hearing date would have left the state and defense counsel just over a week to view and go through the lengthy report. Due to that, the court set a status on the matter for Tuesday. A joint motion to continue was entered to record on Tuesday and the sentencing is now set to be held January 16 at 1pm. Hammer entered an open plea of guilty to one count of aggravated battery to a child under the age of 13 with great bodily harm or permanent disability which is a Class X Felony and it is punishable by 6-30 years in prison.
