A measure opponents say “radically expands liability in Illinois for members of the firearm industry” faces a federal lawsuit less than two days after it was singed into law. Just before the measure was signed Saturday, Illinois Attorney General Kwame Raoul said it doesn’t target those who conduct themselves in a lawful manner.
The measure allows lawsuits against the firearms industry for allegedly making the public less safe or for advertising to children or for paramilitary or militia activity. U.S. LawShield’s Kirk Evans warned of a bevy of lawsuits if the law is upheld.
In their lawsuit filed Monday challenging the law, the National Shooting Sports Foundation said the measure is “specifically designed to evade the judgment of congress–and the Constitution.” NSSF also raises challenges around interstate commerce, the First and Second Amendments and the federal Protection of Lawful Commerce in Arms Act.
