The smell of raw cannabis may soon no longer be grounds for a vehicle search in Illinois with legislation advancing at the Statehouse.
Senate Bill 42 passed the Senate last month. In a House committee on Friday, State Representative Curtis Tarver explained separate cases recently decided by the Illinois Supreme Court made the smell of burned cannabis no grounds for a search, but the smell of raw cannabis is.
Questions were raised about what the change would mean for law enforcement smelling raw cannabis after pulling over suspected traffickers.
The Illinois House returns to session today. Session is scheduled to end May 31st.
