A new date for a sentencing hearing is pending in the case of a Vandalia woman charged with injuring her at that time 3 ½ month old son in early 2016. Fayette County State’s Attorney Josh Morrison and defense attorney Patrick Schaufelberger appeared in court on Thursday. The court was informed by defense counsel of the relevance from a Dr. Gunderson that had previously met with Hammer. After it was decided that Dr. Gunderson’s testimony would not add any new information to the proceedings, a sentencing hearing was set for February 28 at 1pm pending the availability of state witness and defense mitigation witnesses. Hammer entered an open plea of guilty on October 3, 2017 to one count of aggravated battery to a child under the age of 13 with great bodily harm or permanent disability following the injuring of her at that time 3 ½ month old son in early 2016. The charge of aggravated battery to a child under the age of 13 with great bodily harm or permanent disability is a Class X Felony and it is punishable by 6-30 years in prison.
