A former Vandalia resident and Correctional Officer at the Vandalia Correctional Center charged with bringing contraband into a penal institution and official misconduct made an appearance in Fayette County Court on Friday morning. 30-year old Cody J. Hawkins made his first appearance with defense attorney Stephen Friedel as a motion to substitute the judge in the case was heard. With no objection from the special appellate prosecutor handling the case, the motion was allowed by Judge Daniel Hartigan. Hawkins then waived any formal arraignment and entered into record a plea of not guilty in the matter and also waived a preliminary hearing. A request was made for bond reduction which was allowed to be reduced from $200,000 to $35,000. A pre-trial in the matter is now set for November 28 at 10am. Hawkins is charged with one count of Bringing Contraband Into a Penal Institution, which is a Class 1 Felony and punishable by 4 to 15 years in prison. Hawkins is also charged with Official Misconduct, a Class 3 felony punishable by 2 to 5 years in prison and one count of Unlawful Possession with Intent to Deliver a Controlled Substance, also a Class 3 Felony punishable by 2 to 5 years in prison.
