The trial of a Vandalia man charged with three counts of child pornography is set to begin this morning in Fayette County Court. 56-year old William Frakes is charged with two counts of child pornography for allegedly obtaining photographs of a sadistic nature depicting a victim reasonably known to be under the age of 13, both Class X felonies, as well as one count of child pornography for allegedly possessing a photograph depicting a victim reasonably known to be under the age of 13, a Class 2 felony. A final telephone conference call was held at the end of last week during which Defense Attorney Robert Bas made an oral motion to vacate today’s trial date and continue the matter. State’s Attorney Josh Morrison objected the motion and Judge Kevin Parker noted that both parties had previously announced in court several times that they were ready for trial and denied the defense’s oral motion. With the previously set trial date standing, the trial will begin with jury selection at 8:30am this morning.
