The 24-year old Chicago man who is charged with escaping from the Vandalia Correctional Center in September of 2014 had his case continued again in Fayette County Court on Tuesday. Marcus Battice appeared in court with public defender Bill Starnes for a status hearing. Defense counsel reported that they were still waiting on the report expert Dr. Cuneo who was appointed back on September to do an examination to see if Battice was sane at the time of the alleged escape. The motion for that examination was approved after an earlier motion for reexamination to determine fitness for trial was denied after Battice had already been found fit to stand trial by DHS. With counsel waiting for a report to be submitted that was expected to take just about a month to receive, the matter was reset for another status hearing on January 6 at 10am and it has been entered into record that Dr. Cuneo has until January 17th to submit the examination report. Battice remains in custody at Fayette County Jail.
