With a pending motion for a judge recusal set for hearing on October 20, a Vandalia man charged with three counts of child pornography may possibly also have new counsel after the scheduled court date. 56-year old William Frakes of Vandalia is charged with three counts of child pornography, with two counts being Class X felonies and the third a Class 2 felony. After informing his counsel, public defender Ed Potter, at a September 1 hearing that he wished for a motion to be made asking Judge Don Scheafor to be recused from the case, the hearing on this issue by Judge Kevin Parker was continued during a late September hearing and reset for October 20. Also at that hearing, it is now expected that a motion for withdrawal of counsel will be decided on as well. A motion for leave to withdraw as counsel was filed on Monday by Potter. The motion to substitute hearing and a possible preliminary hearing will be held on October 20 at 11am. Frakes currently remains in Fayette County Jail on $350,000 bond.
