Sentencing for a Vandalia woman who entered an open plea of guilty in October for aggravated batter of her at the time 3 ½ month old son, has been called off for today. 24-year old Aubree Hammer was set to be sentenced today in Fayette County Court, however, due to the length of the pre-sentence investigation report, the sentencing hearing will be reset for a date to be determined by the state and defense in the future. Court documents state that the length of the PSI filed last week was well over 200 pages. That would have left the state and defense counsel just over a week to view and go through the lengthy report. Due to that factor, a motion was made by the court to vacate today’s setting in lieu of a future date. Hammer entered an open guilty plea to one count of aggravated battery to a child under the age of 13 with great bodily harm or permanent disability which is a Class X Felony and it is punishable by 6-30 years in prison.
