A Vandalia woman who is charged with aggravated battery of a child resulting in great bodily harm or permanent disability is scheduled to appear in Fayette County Court today for a possible plea. 24-year old Aubree Hammer is scheduled to appear in front of Judge Don Sheafor at 10am this morning for what is expected to be an open plea. With an open plea as opposed to a plea bargain, the defendant in a case enters a plea of guilty and then the sentence for that person is determined by the judge. Should Hammer go forward with the open plea of guilty, a separate date would be set for a sentencing hearing. Hammer is alleged to have injured her, at that time, 3 ½ month old baby in February of 2016 and is charged with one count of aggravated battery to a child under the age of 13 with great bodily harm or permanent disability. The offense is a Class X Felony and it is punishable by 6-30 years in prison. Hammer remains in the Fayette County Jail on $1 million bond.
