The re-sentencing hearing for a now 21-year old Loogootee man convicted of murder has been confirmed for April 3 in Fayette County Court. A conference call was held Thursday in the case of Clifford W. Baker and after several delays, both the state and the defense have declared they are ready and there should be no further delays leading up to the hearing that has been scheduled for April 3rd at 9am. At the time he was found guilty of first degree murder and home invasion and the original sentencing in the case, Baker was under the age of 18, but was tried and then sentenced as an adult to life in prison without the possibility of parole. However, a Supreme Court decision found it unconstitutional to have someone who, at the time, was under the age of 18 to not have the possibility of parole—so Baker must now be re-sentenced in Fayette County Court although his original convictions do remain in place.
